Notice Upon Order for Service by Publication

The State of Missouri to: All unknown husbands, wives, grantees, successors, assigns, heirs, lessees or devisees of the persons named in the Petition for Condemnation as defendants: JEFFREY D. POOR, TRUSTEE OF THE JERRY D. POOR AND BARBARA J. POOR FAMILY TRUST; JEANINE MERSMAN, TRUSTEE OF THE JERRY D. POOR AND BARBARA J. POOR FAMILY TRUST; BRENT KARHOFF, KNOX COUNTY COLLECTOR; and BARBARA J. POOR, whose names, residences or whereabouts are unknown to plaintiff so that personal service cannot be had upon them within the State of Missouri; AND to all other persons, corporations, associations, and legal entities who may claim an interest in the affected property who are incapable of being personally served after due diligence in attempting personal service, or whose names, residences or whereabouts of are unknown to plaintiff or so that personal service cannot be had upon them within the State of Missouri.

 

YOU ARE HEREBY NOTIFIED that an action has been commenced against you in the Circuit Court of Knox County, Missouri, the object and general nature of which is to condemn real property described below for the purpose of erecting overhead electric lines on certain property located in Knox County, Missouri; and to secure the appointment of three (3) commissioners to assess the damages, if any, which said defendants may sustain in the consequence of the taking of the property which is the subject of the Petition.

The names of all of the foregoing defendants to said suit are stated above, and the name and address of the attorney of plaintiff is Lucas T. Pendry, Armstrong Teasdale LLP, 7700 Forsyth Blvd., Suite 1800, St. Louis, Missouri 63105 and the telephone number is (314) 621-5070.

YOU ARE FURTHER NOTIFIED that on January 11, 2019, in the Circuit Court of Knox County, Missouri at 11:00 a.m., or as soon thereafter as the cause can be reached, is the time and place fixed for the hearing of the Petition for Condemnation in said action, and unless you file an answer or other pleading, or shall otherwise appear and defend against the aforesaid petition on or before said time, judgment will be rendered against you for the appointment of said commissioners for the relief demanded in the Petition for condemnation.

An easement one hundred and fifty (150) feet in width in, on, upon, along, over, through, across, and under a tract of land as previously described in this Easement Document being parallel with, adjacent to, and seventy-five (75) feet on each side of the following described line:

Commencing at an iron pin at the Northeast corner of the Northwest Quarter of Section 34, Township 61 North, Range 11 West of the Fifth Principal Meridian, said iron pin being located at North coordinate 468345.77 and East coordinate 533439.29 of the Missouri Plane Coordinate System (Central Zone NAD ’83-2011); Thence South 19°05’12” West a distance of 5644.99 feet to a point located at North coordinate 466719.92 and East coordinate 532876.71 of said coordinate system and being the beginning of the easement herein described; Thence South 63°52’26” East a distance of 7365.09 feet to a point located North coordinate 465731.49 and East coordinate 534892.03 of said coordinate system and being the termination of said easement. All bearings are grid and all distances are ground. The State Plane coordinates are meters.
